EDWARD F. WHIPPS: When a couple has to make a decision whether they're going for a divorce or a dissolution, the real issue is--can they work at a dissolution? A dissolution requires that they be able to agree on all of the issues, whether they are custody issues, division of property, who's going to pay what bills. All of the things have to be able to be agreed.
When a couple is able to work out an agreement with each other on all of the issues, then a dissolution is by far the most dignified, the most respectful way to conclude their marriage.
For most clients, a dissolution certainly has a lot less emotional overlay on it. When they can end their marriage with respect for each other, it bodes well for the future, particularly when they have children. Some people think that if they have substantial assets or complex business issues that they can't really do a dissolution. That's not true. Any couple that's able to be straight with each other can do it.
Sometimes people want to maintain privacy to the extent that they don't even want to have to go to the courthouse and be seen in that public setting. And we can work it out to have a private judge appointed to the case to come to a lawyer's office and simply handle the divorce or the dissolution right in the office.
