EDWARD F. WHIPPS: Some of the unique considerations in high asset cases include figuring out what is the real value of a business. The other major issue that we face in complex cases is determining what portion of the property is a marital asset and what portion of it is what's called separate property.
Separate property generally will stay with the person whose separate property it is. But we often face complex tracing problems to see what percentage of a given asset is marital and what percentage is separate.
In a business situation, it's critical to both parties that the business continue successfully. So we want to make sure that whatever we do, we minimize the chance for harm to the business. At the same time, we recognize that we have to offset the value of that business to the other spouse.
Finding the right strategy to accomplish this goal is where experience really matters. Having the opportunity to do this many, many years gives me the opportunity to look at different strategies that have worked, some that haven't, and to come up with unique ideas that help structure the result that we want.
