In order to file for an uncontested divorce in Ohio, one of the parties—the plaintiff—must meet certain state and county residential requirements. To file for divorce in any Ohio county, the plaintiff must have lived in that county for at least 90 days.

While the process for a dissolution and an uncontested divorce are similar, both parties must be present for the final dissolution hearing, but only the plaintiff needs to be present at the final hearing for an uncontested divorce. Sometimes there are situations when one of the parties has moved and cannot easily attend a final dissolution hearing. In such situations, an uncontested divorce is the better choice, since only one party needs to be present at court for the final hearing. As in a dissolution, the terms of the agreement have already been reduced to writing and placed into the Final Decree of Divorce, which each party has signed.
