Uncontested Divorce

Columbus Ohio Uncontested Divorce Lawyers

Under certain circumstances, two parties will decide the only solution to their problems is a divorce. That said, they can still reach an amicable agreement. Not all divorces are complicated or time-consuming. This is especially true with experienced and skilled attorneys working toward that result. Thus, a divorce may conclude with an uncontested hearing after a settlement is reached, which ends the divorce process with minimal expense and heartache.

In order to have an uncontested divorce, both parties must agree on all the terms of their divorce. As applicable, both parties need to agree on the following issues:

  • Child custody
  • Parenting time schedule
  • Child support
  • Property division
  • Allocation of marital debt
  • Spousal support

In order to file for an uncontested divorce in Ohio, one of the parties—the plaintiff—must meet certain state and county residential requirements. At the time of filing, the plaintiff must have been an Ohio resident for at least six months. To file for divorce in any Ohio county, the plaintiff must have lived in that county for at least 90 days.

While the process for a dissolution and an uncontested divorce are similar, both parties must be present for the final dissolution hearing, but only the plaintiff needs to be present at the final hearing for an uncontested divorce. Sometimes there are situations when one of the parties has moved and cannot easily attend a final dissolution hearing. In such situations, an uncontested divorce is the better choice, since only one party needs to be present at court for the final hearing. As in a dissolution, the terms of the agreement have already been reduced to writing and placed into the Final Decree of Divorce, which each party has signed.
